Conditions
A. Validity
The following general terms and conditions of Come Together Experience GmbH apply exclusively to all orders relating to the delivery of tickets and merchandising items. No guarantee is given for the accuracy of the data on the Come Together Experience GmbH website.
B. Conclusion of contract
The offer to conclude a contract is made by the customer as soon as he clicks on "Order" to complete the ordering process. A contract between the customer and Karsten Jahnke Konzertdirektion GmbH only comes into existence when Karsten Jahnke Konzertdirektion GmbH sends an e-mail confirmation.
Purchasing admission tickets creates contractual relationships with regard to attending the event exclusively between the ticket holder (customer) and the organizer - Come Together Experience GmbH. If Karsten Jahnke Konzertdirektion GmbH is not the organizer itself, it only arranges the event contract in the name of and on behalf of the respective organizer. The general terms and conditions of the local organizer may apply to these legal relationships.
C. Price Composition and Payment
The customer undertakes to pay the ticket price to Karsten Jahnke Konzertdirektion GmbH. This is made up as follows:
Value-added tax is included in the price.
When ordering online, a processing fee may be charged; this fee is shown separately.
Advance booking fees, which are usually included in the ticket prices stated on these pages; otherwise they will be shown separately. Shipping fees apply if the tickets are sent by post.
D. Cancellation and Return Rights
When buying tickets, there is no distance contract according to § 312b BGB. This means that a right of withdrawal and return is excluded. Every order of admission tickets is binding immediately after confirmation by Karsten Jahnke Konzertdirektion GmbH and obliges you to accept and pay for the ordered tickets. The right of termination according to § 649 BGB is excluded.
E. Limitations of Liability, Exclusion of Rescission in the Case of Certain Breaches of Duty
In any case, Come Together Experience GmbH is liable without limitation under the Product Liability Act, in the event of fraudulent concealment of defects, as well as for damage resulting from injury to life, limb or health. Liability for damage resulting from the breach of a guarantee is also unlimited. For the rest, the liability of Come Together Experience GmbH is limited to intent and gross negligence.
The right of the customer to withdraw from the contract due to a breach of duty for which Come Together Experience GmbH is not responsible and which does not result from a defect in the admission ticket or merchandising item is excluded.
Insofar as the liability of Come Together Experience GmbH is excluded or limited according to the above paragraphs, this also applies to the liability of its vicarious agents.
F. Privacy and Data Processing
Karsten Jahnke Konzertdirektion GmbH processes personal data in compliance with the data protection regulations applicable to the contract. Karsten Jahnke Konzertdirektion GmbH is entitled to transmit this data to third parties commissioned by it to process the purchase contract, insofar as this is necessary so that the concluded contracts can be fulfilled.
G. Photography and Filming
At the Come Together - The Hamburg Beatles Experience event, the media, festival sponsors and/or the organizer will create, reproduce and use photos and films, e.g. or Internet (e.g. homepage, Facebook etc.). By entering the participating locations and the Spielbudenplatz, every visitor to the festival agrees that these recordings also show the person of the visitor and may be used for the aforementioned purposes without compensation.
H. Final Clauses
It is only the law of the Federal Republic of Germany.
The sole place of performance for delivery, service and payment is Hamburg, provided the customer is an entrepreneur within the meaning of Section 14 of the German Civil Code.
If the customer is a merchant, the exclusive (also international) place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship is Hamburg. In the case of cross-border contracts, this also applies to non-merchants. Come Together Experience GmbH reserves the right to appeal to any other internationally competent court.
